LEGAL NOTICE AND PRIVACY POLICY

In compliance with the provisions of Royal Decree 1906/99 of 17 December, which regulates electronic contracting, and in the Law on the Regulation of Retail Trade (Law 7/1996 of 15 January, amended by Law 47/2002 of 19 December) with regard to the provisions on distance sales in articles 38 and following, and in the Community Directive 2000/31 of 8 June, concerning certain legal aspects of electronic commerce in the internal market, hereinafter THE COMPANY informs:

The present document is the general regulation of the services provided by THE COMPANY through its web page www.new.kingpalm.es, constituting the legal framework that develops the present contractual relationship of purchase and sale.

These General Conditions are subject to the provisions of :

- Law 3/2014, of 27 March, which amends the revised text of the General Law for the Defence of Consumers and Users and other complementary laws, approved by Royal Legislative Decree 1/2007, of 16 November.

-Law 7/1998, of 13 April 1998, on General Contracting Conditions.

-Royal Legislative Decree 1/2007, of 16 November, approving the revised text of the General Law for the Defence of Consumers and Users and other complementary laws, Law 23/2003, of 10 July, on Guarantees in the Sale of Consumer Goods.

-Royal Decree 1906/1999, of 17 December 1999, regulating Telephone or Electronic Contracting with general conditions.

-Organic Law 15/1999, of 13 December 1999, on the Protection of Personal Data.

-Law 7/1996, of 15 January 1996, on the Regulation of Retail Trade, amended by Law 47/2002, for the transposition into Spanish law of Directive 97/7/EC on distance contracts and for the adaptation of the law to various Community directives.

-Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce.

The services offered by THE COMPANY may be contracted by any user who complies with the requirements established in these CONTRACTING CONDITIONS AND LEGAL NOTICE available at all times on THE COMPANY'S website.

PURPOSE OF THE CONTRACT

The purpose of the contract is to regulate the general conditions of service offered by THE COMPANY.

Access to the information included in the website is completely free of charge, while the service of purchasing products is onerous, specifying at all times the current prices of the product, freight prices and taxes.

The contracting procedure will be carried out in the Spanish language in all cases, with the COMPANY being able to establish the possibility of contracting the service in other specified languages.

2. IDENTIFICATION OF THE CONTRACTING PARTIES.

On the one hand, THE COMPANY, with commercial name or company name SPACESEED, S.L. with registered office at C/ La Palma, 42, 28004 Madrid, with telephone number 628454585 and inscription number in the Mercantile Register of Madrid REGISTERED ON 15 SEPTEMBER 2000 in folio 120 of volume 15.643 General, INSCRIPTION 1 of bank account M-263.444 with CIF: B82729484 and contact e-mail info@kingpalm.es.

And, on the other hand, by THE CUSTOMER, whose data entered to make the purchase or to make a suggestion, through the form established for this purpose, are those that have been entered by him/her. All the data included in the same have been entered directly by the CLIENT, so that the responsibility for the authenticity of the same corresponds directly and exclusively to the CLIENT.

Access and/or use of this King Palm portal attributes the condition of USER, who accepts, from said access and/or use, the General Conditions of Use reflected herein. The aforementioned Conditions shall be applicable independently of the General Contracting Conditions which, where applicable, must be complied with.

3. OBLIGATIONS RELATING TO THE PURCHASE PROCEDURE

The CLIENT is solely responsible for the veracity of the data entered by him/her in the purchase procedure and accepts the obligation to provide true, accurate and complete data.

If the CLIENT does not comply with this obligation, he/she will be responsible for any possible damages caused to the COMPANY or to a third party.


4. CONDITIONS OF SERVICE

The commercial conditions of this service and the offers that THE COMPANY may make always appear on the aforementioned website and, therefore, can be consulted, filed or printed.

THE COMPANY reserves the right to modify at any time the present General Conditions of Contract as well as any other document that appears on the web page.

5. LIABILITY.

The COMPANY will not be responsible for the delays or failures that occur in the access, functioning and operability of the Web Site, as well as for the interruptions, suspensions or malfunctioning of the same, when they have their origin in breakdowns produced by natural catastrophes or situations of force majeure, or of extreme urgency, such as strikes, attacks or intrusions or any other situation of force majeure or fortuitous cause, as well as errors in the telematic data transfer networks and, in any case, when the error is attributable to a third party outside the organisation of THE COMPANY.

THE COMPANY is responsible for the reliability, truthfulness and accuracy of the contents, data or information on the products offered on its website, unless these have been modified by third parties, whether or not outside the organisation, without the express authorisation of THE COMPANY.

The service provided by THE COMPANY is limited exclusively to the provision of the products to customers, being responsible for them in the event that there is any type of non-conformity with them under the terms established in the Law on the Guarantee of Durable Consumer Goods.

In the event that the websites owned by THE COMPANY may contain banners that allow the user to access websites or links owned by third parties, THE COMPANY is not responsible for the contents that may be hosted therein.

THE CLIENT undertakes to comply with the provisions of the LEGAL NOTICE and the CONDITIONS OF CONTRACT published by THE COMPANY on its website at the time of purchase of the product.

www.new.kingpalm.es provides access to a multitude of information, services, programmes or data (hereinafter "content") on the Internet belonging to King Palm or its licensors to which the USER may have access. The USER assumes responsibility for the use of the portal. This responsibility extends to the registration required to access certain services or content. In this registration, the USER shall be responsible for providing truthful and lawful information. As a consequence of this registration, the USER may be provided with a password for which he/she shall be responsible, undertaking to use it diligently and confidentially. The USER undertakes to make appropriate use of the contents and services (such as chat services, discussion forums or news groups) that King Palm offers through its portal and, by way of example but not limitation, not to use them for (i) engaging in activities that are illicit or contrary to good faith and public order, (ii) disseminating contents or propaganda of a racist, xenophobic, pornographic, illegal nature or in support of terrorism or human rights; (iii) cause damage to the physical and logical systems of King Palm, its suppliers or third parties, introduce or disseminate computer viruses or any other physical or logical systems capable of causing the aforementioned damage; (iv) attempt to access and, where appropriate, use the e-mail accounts of other users and modify or manipulate their messages.

King Palm reserves the right to remove all comments and contributions that violate respect for the dignity of the person, that are discriminatory, xenophobic, racist, pornographic, that violate youth or childhood, public order or safety or that, in its opinion, are not appropriate for publication. In any case, King Palm will not be responsible for the opinions expressed by users through forums, chats or other participation tools.
